2. What these Terms cover
These Terms and Conditions ("Terms") govern all flooring fitting services we provide to residential customers. By accepting our written quote, you ("you", "the customer") agree to be bound by these Terms.
These Terms do not affect your statutory rights. As a consumer, you have rights under the Consumer Rights Act 2015 and other applicable legislation that these Terms cannot override.
3. Our service — what is included
FitFloors provides a labour-only flooring fitting service. We install flooring materials that you have purchased. We do not supply or sell flooring materials.
What is included in our quoted price:
- Installation of the flooring materials you supply (labour)
- All tools required for installation
- Fixing materials: gripper rods, adhesive, staples, nails and fixings as appropriate to the flooring type
- Door bars, threshold strips and edging strips (unless materials are unusually specified — we will advise)
- Underlay fitting where underlay is included in the quote
- Subfloor assessment during the quote visit
- Clearing away of our own waste materials after fitting is complete
What is not included unless separately quoted and agreed in writing:
- Flooring materials (carpet, laminate, LVT, engineered wood, vinyl, underlay — you purchase these)
- Removal and disposal of existing flooring
- Furniture removal (we ask that rooms are clear and furniture-free before we arrive)
- Structural repairs to joists, floorboards or subfloor beyond surface levelling
- Fitting of skirting boards or architraves
4. Quotations
All quotes are free. Quotes are provided in writing by WhatsApp or email and include a breakdown of what is covered.
Quotes are based on information available at the time of the site visit. If conditions on the day of fitting differ materially from those assessed — for example, concealed subfloor damage, missing materials, or rooms that are not cleared as agreed — we will advise you before proceeding and may issue a revised quote. We will not start additional work without your written agreement on price.
Quotes are valid for 30 days from the date issued. Accepting a quote in writing (including by WhatsApp message) forms a contract between you and FitFloors on these Terms.
5. Your obligations
To allow us to carry out the fitting safely and correctly, you agree to:
- Ensure that all flooring materials, underlay and accessories are at the property and readily accessible before fitting begins
- Ensure that rooms to be fitted are clear of furniture and personal belongings before we arrive, unless furniture moving has been agreed and quoted separately
- Ensure that adequate access to the property (parking, entry, the rooms to be fitted) is available on the agreed date
- Ensure that an adult aged 18 or over is present throughout the fitting
- Check that the flooring materials you have purchased are the correct product, colour, quantity and specification for your requirements before our arrival
If you do not fulfil these obligations and we are unable to proceed with the booking as a result, we reserve the right to charge a reasonable call-out fee to cover our travel costs and time. We will tell you in advance what this fee is.
6. Cancellation
Your right to cancel (cooling-off period)
Where you accepted our quote at a distance (for example, by phone, WhatsApp or this website) or away from our business premises, you have a legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel the contract within 14 days of accepting the quote, without giving a reason and without charge.
To exercise this right, contact us before the 14-day period expires:
Email: [PLACEHOLDER_EMAIL]
WhatsApp: 07470 799503
If you ask us to begin fitting within the 14-day cancellation period and then cancel part-way through, you will be liable for the cost of work already completed, calculated on a pro-rata basis.
Cancellation after the 14-day period
If you cancel after the 14-day window, we may charge a reasonable cancellation fee to cover:
- Any materials ordered specifically for your job that cannot be returned
- Time already allocated to your booking that we are unable to rebook at short notice
We will tell you the cancellation fee before confirming your cancellation, and we will do our best to keep it fair.
Our right to cancel
We reserve the right to cancel or reschedule a booking if circumstances beyond our reasonable control prevent us from attending (for example, illness, vehicle breakdown or emergency). We will contact you as soon as possible and offer the earliest available rescheduled date at no extra cost to you.
7. Pricing and payment
All prices quoted are for labour only unless stated otherwise in the written quote.
[PLACEHOLDER — VAT status: confirm with owner before publishing. If VAT registered, replace this paragraph with: "All prices are exclusive of VAT, which will be charged at the standard rate applicable at the time of the job." If not VAT registered, replace with: "FitFloors is not VAT registered. Quoted prices are the total price — no VAT is added."]
Payment is due in full on completion of the fitting unless a deposit arrangement has been agreed in writing before work begins.
Accepted payment methods: [PLACEHOLDER — owner to confirm: cash, bank transfer, card, etc.]
We reserve the right to charge statutory interest on late payments under the Late Payment of Commercial Debts (Interest) Act 1998, though we will always seek to resolve payment queries informally first.
8. Our responsibility to you
We will carry out all fitting work with reasonable care and skill, as required by the Consumer Rights Act 2015.
If you consider our work to be defective:
- Contact us within 30 days of the fitting date (see section 9).
- Under the Consumer Rights Act 2015, if a service is not carried out with reasonable care and skill, you are entitled to ask us to repeat the relevant part of the service. If repeat performance is not possible or practical, you may be entitled to a price reduction.
We are responsible for:
- Damage to your property caused directly by our negligence during fitting
- Fitting defects that are caused by our workmanship
We are not responsible for:
- Defects caused by flooring materials supplied by you (wrong product specification, damaged goods supplied, insufficient quantity)
- Subfloor conditions that were not apparent and could not reasonably have been identified during the quote visit
- Damage to items left in rooms that we advised should be cleared before we arrived
- The performance or durability of flooring materials you have purchased — all product warranties remain with the manufacturer and/or retailer
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot lawfully be limited or excluded under English law
9. Complaints
If you are unhappy with any aspect of our service, please contact us as soon as possible:
Email: [PLACEHOLDER_EMAIL]
WhatsApp: 07470 799503
We aim to respond to complaints within 2 working days and to agree a resolution within 10 working days. If we are unable to resolve the matter, we can discuss further options including independent dispute resolution.
As a consumer, you also have the right to seek redress through the courts or through alternative dispute resolution (ADR) services independent of us.
10. General
Entire agreement: These Terms, together with the written quote, form the entire agreement between us for the fitting services described. They replace any previous verbal or written understandings.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to apply.
No waiver: If we do not enforce a right under these Terms on one occasion, that does not mean we waive that right in future.
Third parties: These Terms do not confer any rights on third parties under the Contracts (Rights of Third Parties) Act 1999.
11. Governing law
These Terms and any dispute arising from them are governed by the law of England and Wales. Any legal proceedings must be brought in the courts of England and Wales.
